1. Acceptance of Terms
By accessing and using the Worksy mobile application and services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services.
These Terms constitute a legally binding agreement between you and Worksy. We reserve the right to modify these Terms at any time, and your continued use of the Services constitutes acceptance of any changes.
2. Description of Services
Worksy is a platform that connects clients seeking local services with independent service providers ("Workers"). We provide the technology platform but do not employ Workers or provide services directly. Workers are independent contractors, not employees of Worksy.
3. Eligibility
To use our Services, you must:
- Be at least 18 years of age
- Have the legal capacity to enter into binding contracts
- Provide accurate and complete registration information
- Comply with all applicable laws and regulations
4. User Accounts
4.1 Account Registration
You must create an account to use certain features of our Services. You agree to provide accurate, current, and complete information and to keep your account information updated.
4.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access or use of your account.
4.3 Account Suspension
We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or any other reason we deem appropriate.
5. Worker Verification
Workers must complete our verification process, which may include:
- Identity verification
- Background checks
- Skills assessment
- Proof of insurance or licensing where required
While we conduct verification, we do not guarantee the accuracy of all information provided by Workers. Clients should exercise their own judgment when hiring Workers.
6. Payments and Fees
6.1 Service Fees
Worksy charges service fees to facilitate platform operations. Clients pay a service fee on top of the Worker's rate. Workers pay a service fee (typically 15%) deducted from their earnings.
6.2 Payment Processing
All payments are processed through our third-party payment processor, Stripe. Client payments are held in escrow until work is completed and approved. Workers receive payment within 2-3 business days after job completion.
6.3 Refunds and Disputes
Refund requests must be submitted within 48 hours of job completion. We will review disputes fairly and may issue full or partial refunds at our discretion. Clients should not release payment until satisfied with completed work.
7. User Conduct
You agree not to:
- Violate any laws or regulations
- Infringe on intellectual property rights
- Harass, abuse, or harm other users
- Post false, misleading, or fraudulent content
- Attempt to circumvent platform fees or payment systems
- Use automated systems to access the Services
- Interfere with the proper functioning of the Services
- Collect user information without consent
8. Content and Intellectual Property
You retain ownership of content you post, but grant Worksy a worldwide, non-exclusive license to use, display, and distribute your content in connection with our Services. You represent that you have all necessary rights to the content you post.
All Worksy trademarks, logos, and service marks are the property of Worksy. You may not use them without our prior written permission.
9. Disclaimers and Limitation of Liability
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THE QUALITY, SAFETY, OR LEGALITY OF SERVICES PROVIDED BY WORKERS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WORKSY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICES.
10. Indemnification
You agree to indemnify and hold harmless Worksy and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Services or violation of these Terms.
11. Dispute Resolution
Any disputes arising from these Terms or your use of the Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.
12. Governing Law
These Terms shall be governed by the laws of the State of California, without regard to its conflict of law provisions.
